When you visit our website https://www.dentity.com or use any of our website or services (hereafter the “Services”), we understand that you are trusting us with your personal information.  We take your privacy seriously and seek to explain to you in the clearest terms possible what information we collect, how we use it, and what rights you have as it pertains to your personal data.  If there are any terms in this privacy notice that you do not agree with, please discontinue use of our Services immediately.  This notice and these terms apply to all information collected through our Services as well as any related services, sales, marketing or events.

You acknowledge that you have read, understand and agree to our Terms of Service.  The Terms of Service is hereby incorporated into and made part of the Privacy Policy by reference.

The Information We Collect

We collect personal information that you voluntarily provide to us when you create an account or are invited to use the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.  The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make and the products and features you use.  The personal information we collect may include the following:

Personal Information Provided by You

When you verify your identity using the Services, we collect your personal information. This information may include your first and last name, address, date of birth, email address, and mobile phone number, among other personally identifiable information.  We may also collect information which is obtained from the identification document you share with us, including for example driver’s license or passport number.  All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information

Payment Information 

We may collect data necessary to process your payment if you make a purchase, such as your credit card or debit card number and the expiration and security code associated with such form of payment.  All payment information is stored in Stripe, and you can find their privacy notice here: https://stripe.com/privacy.

Information Automatically Collected

Some information, like your IP address and your browser and device characteristics, may be automatically collected when you use our Services.  This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services and other technical information. This information is primarily needed to maintain the security and operation of our Services, for our internal analytics and reporting purposes, and in some cases may be used to confirm or deny access to the Services (e.g., Dentity is currently not available in all countries).  Like many businesses, we also collect information through cookies and similar technologies.  The information we collect includes log and usage data, device data, and location data. 

Information Collected from Other Sources

In order to enhance our ability to provide the Services, including relevant offers and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, social media platforms, as well as from other third parties.  This information may include mailing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), Internet Protocol (IP) addresses, social media profiles, social media URLs and custom profiles, for purposes of targeted advertising and event promotion.  If you interact with us on a social media platform using your social media account (e.g., Facebook or Twitter), we receive personal information about you such as your name, email address, and gender.  Any personal information that we collect from your social media account depends on your social media account’s privacy settings.

How we use Your Information

We use personal information collected via our Services for a variety of business purposes described below.  We process your personal information to pursue our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations.  We use the information that we collect from you to verify your identity, for account creation and login, to post testimonials, to request feedback on our Services, to enable user-to-user communication, to manage user accounts, to protect our Services, to enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements and prevent harm, to fulfill and manage your orders, to administer promotions, to deliver and facilitate delivery of our Services to the user, to respond to inquiries and offer support to our users, to send marketing and promotional communications, and to deliver targeted advertising.

How we Share your Information

We only share information with your consent, to comply with laws, to provide you with Services, to protect your rights, or to fulfill business obligations.  We may process or share your data that we hold based on the following legal requirements:

Consent:  If you have given us specific consent to use your personal information for a specific purpose.

Performance of a Contract:  Where we have entered into a contract with you and we need to process your personal information to fulfill the terms of our contract.

Legal Obligations:  We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena.

Vital Interest:  We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

Business Transfer:  We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

Time Period for Storing your Information

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required by law (such as tax, accounting or other legal requirements).  No purpose in this Policy will require us keeping your personal information for longer than six (6) months past the termination of the user’s account.  When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

How we Safeguard your Information

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process.  However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information.  Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk.  You should only access the Services within a secure environment.

We may use vendors to deliver the Services, and in some cases, they may have access to your personal information and retain copies of it for their records.  We can make no guarantees that such vendor sites won’t be subject to hackers, cybercriminals, or that other unauthorized third parties.

Information from Minors

We do not knowingly solicit data from or market to children under 18 years of age.  By using the Services, you represent that you are at least 18.  If we learn that personal information from users under 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.  If you become aware of any data we may have collected from children under age 18, please contact us at admin@dentity.com.

Your Privacy Rights

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws.  These may include the right to: (1) request access and obtain a copy of your personal information; (2) request rectification or erasure; (3) restrict the processing of your personal information; and (4) if applicable, the right to data portability.  In certain circumstances, you may also have the right to object to the processing of your personal information.  To make such a request, please contact admin@dentity.com.  We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time.  Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.  If you have questions or comments about your privacy rights, you may email us at admin@dentity.com.

If you are a California resident, you are granted specific rights regarding access to your personal information.  California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.  If you are a California resident and would like to make such a request, please submit your request in writing to admin@dentity.com.

You have rights with respect to your personal data, including: (1) the right to request deletion of your data (you may request the deletion of your personal data); (2) the right to be informed (depending on the circumstances, you have the right to whether we collect and use your personal information, the categories of personal information we collect, the purposes for which it was collected and how it was used, and where we sell your information to third parties); and  (3) the right to non-discrimination for the exercise of a consumer’s privacy rights (we will not discriminate against you if you exercise your privacy rights).  If you choose to exercise any of these rights, Dentity has the right to verify your identity to confirm you are the account holder.

Review, Update or Delete the Data we Collect from You

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances. To request to review, update, or delete your personal information, please submit a request to admin@dentity.com.  We will respond to your request within 30 days.

Changes to Privacy Policy and Terms of Service

We reserve the right to amend the Privacy Policy and Terms of Service at our discretion and at any time.  When we make changes to these Terms of Service, we will post the new Terms of Service on the Site. By continuing to access, browse, or otherwise use the Site, you agree to be legally bound by any such new Terms of Service.
